Declaración Re: VENEZUELA, CUBA, NICARAGUA. El Comisionado General, Dr. Humphrey Humberto Pachecker- desde el Distrito de Washington DC, (CORTE AICAC-HR- USA) Ver:http://courtaicac-hr.us/ vía su oficina- radicó una denuncia ante la ‘Oficina del Alto Comisionado para los Derechos Humanos la Oficina de las Naciones Unidas en Ginebra- Suiza’ declarando la masacre cometida por el presidente Nicolás Maduro y sus fuerzas opresivas ejecutando la orden directa del presidente Maduro, así sumado su voz al creciente coro de condena por las ejecuciones extrajudiciales en Venezuela.
Advirtió a la Corte Penal Internacional (CPI) que debe enjuiciar a estos mandatarios criminales si la Organización de las Naciones Unidos, en relación al problemático país, no aborda el tema urgentemente. Además, igualmente en Agosto, 2018 esta Comision para los Derechos Humanos de la Corte AICAC-HR, presentó otra denuncia adicional en contra del presidente de Venezuela Nicolas Maduro, y de Nicaragua Daniel Ortega, igualmente contra Raúl Castro de Cuba por crimenes y violaciones de todos los Derechos Humanos cometidas contra el pueblo y sus ciudadanos.

El Comisionado General, Humphrey Humberto Pachecker tomó la iniciativa y realizando un estudio del problema el cual demuestra que desde que el presidente Nicolás Maduro asumió el cargo, se han producido cientos de asesinatos relacionados con la oposición y las protestas, y la policía con sus paramilitares y los llamados “colectivos’ han asesinado directamente a cientos de civiles presuntos terroristas según el gobierno de Maduro por delitos relacionados con las protestas.
La investigación de Amnistía documenta decenas de casos de asesinatos de personas inocentes. Los investigadores entrevistaron a personas que detallan ejecuciones extrajudiciales en varias ciudades de todo el país. La organización (“IHRCJPI”) también examinó los informes policiales.
Inclusive, auque el presidente Nicolás Maduro invoque como acto de guerra esta ejecución del policía Oscar Pérez, con sus compañeros y otros civiles en una flagrante violación del La Convención de Ginebra (1929) se firmó en Ginebra el 27 de julio de 1929.
Su nombre oficial es la Convención relativa al trato de prisioneros de guerra, Ginebra, 27 de julio de 1929. Entró en vigor el 19 de junio de 1931. Es esta versión de los Convenios de Ginebra la que cubría el tratamiento de los prisioneros de guerra durante la Segunda Guerra Mundial. Es el predecesor de la Tercera Convención de Ginebra firmada en 1949.
Un estado soberano puede rendirse después de la derrota en una guerra, generalmente mediante la firma de un tratado de paz o un acuerdo de capitulación. Una rendición en el campo de batalla, YA SEA POR INDIVIDOUS o cuando los ordenan los oficiales, normalmente hace que los que se rinden se conviertan en prisioneros de guerra.

La infame Asamblea Nacional Constituyente fraudulentamente se eligió en Venezuela con el único apoyo del sector del Chavismo Castrista que anunció su falsa historieta de haber logrado ocho millones de votantes o un 41,53 % del censo electoral, un resultado que fue celebrado por el Gobierno del dictador y duramente cuestionado con total claridad de fraude con la denuncia de la oposición, y de la comunidad internacional, que pone en duda la cifra anunciada por el CNE, el órgano electoral totalmente desprestigiado y de cero credibilidad.
Ya NO queda duda que el Dictador Maduro ha seguido al pie de la letra la doctrina y política de Fidel Castro y Raúl Castro con sus secuaces criminales como fue el Che Guevara y ahora con algunos pupilos en las Américas.
Nosotros tenemos que continuar presionando y denunciando ante las Naciones Unidas como lo hemos hecho desde el año 2014- DE NO LOGRARLO AHORA- VENEZUELA SE CONVIERTE EN OTRA CUBA DE CASTROS YA CON 58 AÑOS DE DICTADURA CRIMINAL.
Enero, 2018. Las fuerzas policiales y militares del gobierno castro comunista del dictador Nicolás Maduro de Venezuela, han cometido una vez más crímenes de ejecuciones extrajudiciales, ahora asesinando a un grupo de militantes de oposición al gobierno de Maduro al no respetarles la vida a pesar de sus declaraciones de rendimiento y entrega a las autoridades policiales y militares del gobierno. http://nafalaw.com/blog/?p=822

Detailed description of the facts of the alleged violation or violations (including relevant dates)*
President Nicolas Maduro of Venezuela imprisons and kills innocent Venezuelans. In addition, the Venezuelan people have suffered enough violations of human and political rights, as they continue taking to the streets in peaceful protest, suffering the brutal and lethal tactics by the Venezuelan government of Nicolás Maduro.
Petitioners include the family members, him and as personal representative of the one individual’s estate all subjected to torture in Communist Cuba , in labor camps and other facilities, supervised by the Defendants under the Defendants control, who were tortured as a result of the violations more detailed described below.
Please see attached hereto Annex document with full allegations with cause of action and its counts.

After careful consideration of the contents of your petition, in which you bring a complaint against Venezuela and Cuba for various alleged human rights violations, we sincerely regret having to inform you that the United Nations Office of the High Commissioner for Human Rights is not in a position to assist you in the matter you raise. Kindly note that the Committee against Torture cannot examine individual communications alleging violations of the Convention against Torture unless the State is also a party to the Optional Protocol to the Convention. Cuba is not a State party to the Optional Protocol, which means that individuals may not bring complaints under the Convention against Torture against Cuba at this time. As to your complaint against Venezuela, kindly note that the Committee against Torture may not examine individual communications unless all available and effective domestic remedies have been exhausted first.
Finally, please note that the Committee against Torture can only examine individual petitions presented by the alleged victims themselves or by duly authorized representatives; the Committee may not consider actio popularis complaint that are brought on behalf of the people at large. You may also wish to note that the Committee against Torture does not have competence to examine claims under the Alien Tort Claims Act or the Torture Victims Protection Act, which are domestic American laws, and that the Committee is not in a position to review the evaluation of facts and evidence by the national courts and authorities, nor can it review the interpretation of domestic legislation.
