Cómo estudiar con eficacia para el examen de la barra.
Es evidente que estudiar para el examen de la barra no es lo más divertido que puedes imaginar. Aunque, si el hacer las preguntas del MBE, sólo por diversión es su idea de un buen rato …. ¿quién soy yo para juzgar? Para aquellos de ustedes que no se divierten partiendo de las preguntas de MBE, ya que no puede hacer que la diversión les de por estudiar más, por lo menos le puedo decir cómo hacerlo más eficaz.

Ensayos: Practique sus ensayos con sus notas, mirando las normas del derecho. Lo sé, esto suena a trampa, pero yo no estoy sugiriendo que lo hagan en el día del examen, yo estoy sugiriendo que lo haga durante la práctica. Además, el examen de la barra es en realidad probando su capacidad para analizar y buscar normas en su esquema, no le ayuda allí. Pero, le ayudará a aprender las reglas correctas, lo que es el primer paso. Además, es más eficaz que tratar de memorizar reglas de esquemas de lectura de una y otra vez, o incluso tarjetas para esa materia. Si nos fijamos en las reglas a medida que escribes, se activa la aplicación de los hechos con esas normas, y la práctica de su escritura, además de aprender las reglas, ya que los estás copiando. Todo esto es el aprendizaje activo, el hacerlo y no sólo la lectura pasiva. Cuando se les da la opción, el aprendizaje activo es siempre más eficaz.

También, por favor escriba a cabo sus ensayos de práctica. Pensando en tu cabeza, o simplemente la redacción de los contornos, no le ayudará. Usted ha oído la práctica hace la perfección? Es un cliché por una razón, y ahora es el momento de poner ese cliché en la prueba. Escribe todos los ensayos que le sea posible en las próximas 5 semanas [5 meses]. Usando las notas, por supuesto.

Es posible que le haya ido mal en el fondo, olvidando algún elemento de la regla, o simplemente sentirse confuso sobre la ‘letra negra de la ley’. How to Study Effectively for the Bar Exam

Clearly, studying for the bar exam is not the most fun thing you can imagine doing. Though, if doing MBE questions just for kicks is your idea of a good time….who am I to judge?  For those of you that don’t get your kicks from MBE questions, since I can’t make the studying more fun, at least I can tell you how to make it more effective.

Essays: Practice your essays with your notes, looking up rules of law. I know, this sounds like cheating, but I’m not suggesting you do it ON the day of the exam, I’m suggesting you do it during practice. Also, the bar exam is actually testing your ability to analyze, and looking up rules in your outline will not help you there. But, it WILL help you learn the correct rules, which is the first step. Plus, it is more effective then trying to memorize rules by reading outlines again and again, or even flashcards for that matter. If you look up rules as you write, you are actively applying facts to those rules, and practicing your writing, in addition to learning the rules, since you are copying them down. This is all active learning; the doing rather than just passively reading.  When given the choice, active learning is always more effective.

Also, PLEASE write out your practice essays. Thinking about them in your head, or just drafting outlines, will not help you. You’ve heard practice makes perfect? It’s a cliché for a reason, and now is the time to put that cliché to the test. Write out as many essays as you can in the next 5 weeks. Using your notes, of course.

MBE: As with the essays, you want to be actively learning from the MBE practice questions. If you do not learn from every MBE question you do, you are wasting your time, and just doing that MBE question for fun. As I said before, I won’t judge….but the general feeling is that MOST people have other things they like to do in their spare time. How does one learn from doing an MBE question? Do one at a time, check the answer, and then figure out what you did wrong.

You might have went wrong on substance; forgetting some element of the rule, or just being confused on the black letter law. In that case, now is the time to review our outlines/flashcards/charts, to brush up on the black letter law. [The black letter law refers to the basic standard elements for a particular field of law, which are generally known and free from doubt or dispute. It may, for example, be the standard elements for a contract or the technical definition of battery].

You might have had a reading comprehension problem, reading the call of the question or a certain fact the incorrect way. If that’s the case, take a mental note and be sure to read a bit more carefully in the future.  Having said that, make sure you are consistently paying attention to the call of the question; variations such as “which is the least likely outcome” often throw students off course if they are not paying attention.

Perhaps you were torn between A and C, and don’t quite understand why C is the better answer, since they both seem ok to you. In that instance, read the explanation in the back of the book, re-read the question, consult with a tutor, do what you need to do to assess why one answer was the “best” out of all options. Sometimes the way to do this is to figure out why the other three options are incorrect. Remember an answer has to be both factually and legally correct, and never only a little bit legally correct.

What all of these things boil down to is learning from your mistakes, something your mother has been telling you to do since you were just a wee thing. The types of questions asked, as well as the rules tested, are often repeated, which means you are likely to see them again and again – so what better way to master them then to learn from each question?  Remember merely tallying your score and shrugging, moving on to review an outline without knowing where your weaknesses are, will not help improve your score. You have to know where you went wrong. You have to learn FROM the questions, and I can not stress that enough.

Having taken this all into consideration, perhaps you might have time, after studying EFFECTIVELY, to actually see your friends in the next 5 weeks. But only once or twice

5. Grupos de estudio son un juego de azar. A menos que se continúa con el mismo grupo que ha estado antes; para encontrar un ritmo adecuado con un grupo de extraños tiene el potencial de disminuir la útilidad y productividad de los estudios.

8. La mejor herramienta: un reloj de pulsera. Usted no será capaz de usar el reloj de su teléfono celular en el examen. Calcular bien el tiempo permitido para cada pregunta, y escribir la hora en su hoja de examen. Después de una hora (1:00) sobre una cuestión de 60 minutos, no se detenga- debe seguir adelante. Cualquiera que sea el número de puntos obtenidos es mejor que escribir por 30 minutos más allá del tiempo asignado; luego no lo puede compensar por faltar a la siguiente pregunta. Usted no obtiene puntos para las preguntas que deja en blanco.

9. Lee bien las preguntas. Lea de nuevo si es necesario. Siga las instrucciones. Si se le pide en el examen que escriba una nota a un cliente, hazlo. Si usted está escribiendo a mano el examen y se le instruye a  escribir en cada línea y en cada página, lo debe hacer. Los examinadores son la última parada en su camino a convertirse en un abogado practicante y las respuestas inadecuadas ponen su condición y preparación en cuestión por lo cual será referido a la Junta de Examinadores. 12 Tips for a Successful Bar Exam- by Susan Gainen .

Thousands of law students launch their careers after successfully navigating the bar exam just once. Use these 12 tips, and you, too, can make it to the admission ceremony on time.

Applying to take the bar exam

1. Make a timely application for both the bar exam and, if you want to type, for using Examsoft. The timely-filing deadline has the lowest fee. If you are reading this in mid-May 2011, you have missed most timely and late deadlines for the July bar.

To get it right next time, check in with your Career Services Office and read the ABA Section on Legal Education and Admission to the Bar’s Comprehensive Guide to Bar Admission Requirements, known affectionately as “The Comp Guide.” It is updated annually, contains dates and deadlines, character and fitness information, fees, and more. Also check in with the Bar Examiners in your state for the most current rules and procedures and whether the Multistate Professional Responsibility Exam (MPRE) is required.

2. Amend your bar exam application when necessary. When bar examiners check records before signing off on your admission and find a mid-June DWI, you are in trouble. Most bar examiners require notification within ten days of the occurrence of any triggering (aka “really bad”) event, and “I forgot” is not an excuse. Bar admission can be delayed or denied.

3. Consider where to sleep the night before the bar exam. If you are coming from out of town, get a hotel room as close to the exam site as possible. “I missed the off-ramp” is not an excuse for being late and you will get no extra time. If you are taking two states’ exams, have both Plan A and Plan B that will get to you to the exam sites on time.

4. Stick to study habits that worked for you while you were in school. If your pattern was studying five hours a day, trying to work for 12-hour stretches may be counter-productive. Whether you take a bar review class or study on your own, take as many real-time practice essay tests as possible. Thousands of sample Multistate Bar exam questions are available. Whether your state drafts its own or uses the Multistate Performance Test (MPT) questions, find them all and practice, practice, practice.

5. Study groups are a gamble. Unless you are continuing with the group you have been in since Torts, finding an appropriate rhythm with strangers has the potential to detract from purposeful and productive studying.

6. Exercise and eat right. Meeting the pizza delivery guy does not count as exercise unless you climb down 30 flights of stairs to get it. Sugar, fat, salt, and caffeine are not food groups.

7. Do not talk to other test-takers for two weeks before the exam. Your friends will remember things that you have never heard of and they will confuse you with their notions of arcane issues of trust law. Don’t let yourself be distracted.

Taking the bar exam

8. Top tool: a wrist watch. You will not be able to use your cell phone’s clock, so beg, borrow, but do not steal a watch, and set it to12 o’clock. Calculate the time allowed for each question, and write the time on your exam sheet. After one hour (1 o’clock) on a 60-minute question, you must move on. Whatever small number of points that you might earn for writing 30 minutes beyond that allotted time will not make up for missing a question entirely. You get no points for questions that you skip.

9. Read the questions. Read them again. Follow the instructions. If you are asked to write a memo to a client, do it. If you are hand-writing the exam and are instructed to write on every other line on every other page, do it. Whether writing or typing, know that a live person will read your answers. Make it as easy as possible for that person to give you points.

10. Using IRAQ, outline your answers, and do not start to write before you think carefully. The late Earle Kyle IV, who graded seven rounds of bar exams, often advised University of Minnesota Law School students that bar exam graders can tell if you write without a plan because relevant issues surface after you have dissected red herrings. You may get points for something on your outline. Can’t remember the law? He suggesting discussing the facts.

11. Telepathy is not a bar exam tool. Kyle advised students that their exams are graded against a grid. He noted that bar exam graders do not know what you know, and that test takers should write down everything. For a ConLaw question, write: “This is a Constitutional Law Question. [1 point] It involves state action [1 point].”

VIOLACIONES Y CRIMENES EN VENEZUELA, NICARAGUA Y EN CUBA por Humphrey Humberto Pachecker

Declaración Re: VENEZUELA, CUBA, NICARAGUA. El Comisionado General, Dr. Humphrey Humberto Pachecker- desde el Distrito de Washington DC, (CORTE AICAC-HR- USA) Ver:http://courtaicac-hr.us/ vía su oficina- radicó una denuncia ante la ‘Oficina del Alto Comisionado para los Derechos Humanos la Oficina de las Naciones Unidas en Ginebra- Suiza’ declarando la masacre cometida por el presidente Nicolás Maduro y sus fuerzas opresivas ejecutando la orden directa del presidente Maduro, así sumado su voz al creciente coro de condena por las ejecuciones extrajudiciales en Venezuela.

Advirtió a la Corte Penal Internacional (CPI) que debe enjuiciar a estos mandatarios criminales si la Organización de las Naciones Unidos, en relación al problemático país, no aborda el tema urgentemente. Además, igualmente en Agosto, 2018 esta Comision para los Derechos Humanos de la Corte AICAC-HR, presentó otra denuncia adicional en contra del presidente de Venezuela Nicolas Maduro, y de Nicaragua Daniel Ortega, igualmente contra Raúl Castro de Cuba por crimenes y violaciones de todos los Derechos Humanos cometidas contra el pueblo y sus ciudadanos.

El Comisionado General, Humphrey Humberto Pachecker tomó la iniciativa y realizando un estudio del problema el cual demuestra que desde que el presidente Nicolás Maduro asumió el cargo, se han producido cientos de asesinatos relacionados con la oposición y las protestas, y la policía con sus paramilitares y los llamados “colectivos’ han asesinado directamente a cientos de civiles presuntos terroristas según el gobierno de Maduro por delitos relacionados con las protestas.

La investigación de Amnistía documenta decenas de casos de asesinatos de personas inocentes. Los investigadores entrevistaron a personas que detallan ejecuciones extrajudiciales en varias ciudades de todo el país. La organización (“IHRCJPI”) también examinó los informes policiales.

Inclusive, auque el presidente Nicolás Maduro invoque como acto de guerra esta ejecución del policía Oscar Pérez, con sus compañeros y otros civiles en una flagrante violación del La Convención de Ginebra (1929) se firmó en Ginebra el 27 de julio de 1929.

Su nombre oficial es la Convención relativa al trato de prisioneros de guerra, Ginebra, 27 de julio de 1929. Entró en vigor el 19 de junio de 1931. Es esta versión de los Convenios de Ginebra la que cubría el tratamiento de los prisioneros de guerra durante la Segunda Guerra Mundial. Es el predecesor de la Tercera Convención de Ginebra firmada en 1949.

Un estado soberano puede rendirse después de la derrota en una guerra, generalmente mediante la firma de un tratado de paz o un acuerdo de capitulación. Una rendición en el campo de batalla, YA SEA POR INDIVIDOUS o cuando los ordenan los oficiales, normalmente hace que los que se rinden se conviertan en prisioneros de guerra.

La infame Asamblea Nacional Constituyente fraudulentamente se eligió en Venezuela con el único apoyo del sector del Chavismo Castrista que anunció su falsa historieta de haber logrado ocho millones de votantes o un 41,53 % del censo electoral, un resultado que fue celebrado por el Gobierno del dictador y duramente cuestionado con total claridad de fraude con la denuncia de la oposición, y de la comunidad internacional, que pone en duda la cifra anunciada por el CNE, el órgano electoral totalmente desprestigiado y de cero credibilidad.

Ya NO queda duda que el Dictador Maduro ha seguido al pie de la letra la doctrina y política de Fidel Castro y Raúl Castro con sus secuaces criminales como fue el Che Guevara y ahora con algunos pupilos en las Américas.

Nosotros tenemos que continuar presionando y denunciando ante las Naciones Unidas como lo hemos hecho desde el año 2014- DE NO LOGRARLO AHORA- VENEZUELA SE CONVIERTE EN OTRA CUBA DE CASTROS YA CON 58 AÑOS DE DICTADURA CRIMINAL.

Enero, 2018. President Nicolas Maduro of Venezuela imprisons and kills innocent Venezuelans. In addition, the Venezuelan people have suffered enough violations of human and political rights, as they continue taking to the streets in peaceful protest, suffering the brutal and lethal tactics by the Venezuelan government of Nicolás Maduro.

Petitioners include the family members, him and as personal representative of the one individual’s estate all subjected  to torture in Communist Cuba , in labor camps and other facilities, supervised by the Defendants under the Defendants control, who were tortured as a result of the violations more detailed described below.

After careful consideration of the contents of your petition, in which you bring a complaint against Venezuela and Cuba for various alleged human rights violations, we sincerely regret having to inform you that the United Nations Office of the High Commissioner for Human Rights is not in a position to assist you in the matter you raise. Kindly note that the Committee against Torture cannot examine individual communications alleging violations of the Convention against Torture unless the State is also a party to the Optional Protocol to the Convention. Cuba is not a State party to the Optional Protocol, which means that individuals may not bring complaints under the Convention against Torture against Cuba at this time.  As to your complaint against Venezuela, kindly note that the Committee against Torture may not examine individual communications unless all available and effective domestic remedies have been exhausted first.

Finally, please note that the Committee against Torture can only examine individual petitions presented by the alleged victims themselves or by duly authorized representatives; the Committee may not consider actio popularis complaint that are brought on behalf of the people at large. You may also wish to note that the Committee against Torture does not have competence to examine claims under the Alien Tort Claims Act or the Torture Victims Protection Act, which are domestic American laws, and that the Committee is not in a position to review the evaluation of facts and evidence by the national courts and authorities, nor can it review the interpretation of domestic legislation.

Las Reglas Regulatorias del Colegio de Abogados de la Florida: Capítulo 16 explica los requisitos para obtener la certificación. Before me this day personally appeared Humphrey Humberto Pachecker (“HHP”) who, being duly sworn deposes and says:

A writ of certiorari (“Cert/Petition”) is a formal request for the United States Supreme Court (“USSC”) to review a lower court’s ruling.  In this case, (‘my case”) HHP’s petition for write of certiorari filed on March 18, 2013 and placed on the docket on March 12, 2013, as Case Number- 12-9192, requesting review of a ruling from The Florida Supreme Court (“FLASC”) under case number SC10-1896, including lower tribunals, et al.

This denial of HHP’s  Cert/Petition by the USSC in the FLASC means its decision stands as a final decision.

This does not mean that the USSC either agrees or disagrees with the decision of the FLASC, only that the case will no be reviewed.

The USSC receives over Five Thousand (5000) Cert/Petitions annually, of those cases, the USSC accept One Hundred (100). The USSC has the discretion to hear only cases they deem appropriate. Constitutionally, those involved in the lawsuit are each entitled to on appeal, which is handled at the district appeals court level which entitlement has not being apply in this case.

The USSC denies must Cert/Petitions because the court has no desire to change the interpretation of modern law.

The USSC agrees to hear cases that are either novel issues or issues that the court believes require guidance when is not in agreement with the United States Constitution.

American Law is based on the principles of precedent, meaning that if a court has already ruled on a given legal issue and another case, as is in my case, arises with the same legal issue, the holding in the previous case shall be applied to the new case, such as must have been in my case.

The use of precedents helps to promote stability in our legal system, as all parties are given notice as to the current state of the law. Adhering to the use of precedent complies with the doctrine of stare decisis.

Precedents also have a role to play when new legal issues are presented to courts. In my case there are no legal new issues, hence I did look to cases that have been decided in the past supporting my current arguments presented to the FLASC and later to the USSC.

Only USSC precedents are binding on all courts. The USSC may decide to hear a case because a State Supreme Court, as it’s in my case, has come to different conclusion on the same legal issued presented as is in my case.

The following precedents illustrate my position in accord to our stare decisis court system.

In The Florida Bar v. Savitt,  363 So.2d 559, the Supreme Court held that, [T]he firm [law office] and its members, associates or employees properly may conduct the following practice of law:… (e)give legal advice on the law of jurisdictions other than Florida to non-Florida clients in transaction with person residing in Florida or with  business enterprises having their principal place of business in Florida; provided that matters of Florida law, if any, are handled by members of The Florida Bar and provided that, if the lawyer giving the legal advice is not a member of The Florida Bar, the lawyer is in Florida on a transitory basis:…

In The Florida Bar v. Moses,  380 So.2d 412, the Supreme Court held that,… [I]f an activity is the practice of law but the activity is authorized, the activity is not the unlicensed practice of law and may be engaged in by a nonlawyer.

In The Florida Bar v. Sperry, 140 So. 2d 587, 591; 373 U.S. 379, the Supreme Court found that setting forth broad definition of the practice of law was “nigh onto impossible.”  Federal statutes authorize the federal commission and agency to prescribe regulations governing the recognition and conduct of agents, foreign attorneys, and other persons representing applicants before these federal agencies.

One of these federal agencies is the United States Citizenship and Immigration Services, regulation 8 C.F.R. ss 103.2(a)(3), states that there are three types of individuals authorized to file legal representation as representatives of applicants or petitioners.

(1)   Attorneys in theUnited States, as defined at 8 C.F.R.ss 292.1(f).

(2)   Foreign attorneys- outside of the United States, as defined at 8 C.F.R.ss 292.1(a)(6).

(3)   Accredited representatives, as defined at 8 C.F.R. ss 292.1(a)(4)

In my case, I am a foreign attorney with U.S. Law education’s degrees in  comparative law and U.S. Immigration law, Federal law of civil procedures, all obtained at local college and university, A.B.A. law school approved.

In my case, I am an attorney former partner and firm supervision/administrator of George Chernoff and Associates dba NAFA Attorneys, P.A., a New York attorney by the Appellate Division of the Supreme Court of the State of New York, First Judicial Department, and the USSC, pursuant to an international and interstate partnership agreement following the principles set forth in the case, The Florida Bar v. Savitt, which dealt with a dispute between The Florida Bar and New York lawyers setting up an office in Florida in which the partner assigned to supervise was not admitted to the practice of law in Florida, as is in my case.

In my case, is a case involving an interstate – international partnership of the type envisioned in ABA Comm, on Professional Ethics and Grievances, Formal Op. 316 (1967). One of the conclusions of that opinion was that: “The Canons of Ethics do not prohibit a lawyer in State I from entering into an arrangement with a lawyer in State II for the practice of law by which they share in the responsibility and liability of each other, if they indicate the limitations on their practice in a manner consistent with the canons. Subject to the same limitations, offices of the firm could be opened in both states. Of course, only the individuals permitted by the laws of their respective states to practice law here would be permitted to do the acts defined by the state as the practice of law in that state, but there are no ethical barriers to carrying on the practice by such a firm in each state so long as the particular person admitted in that state is the person who, on behalf of the firm, vouched for the work of all of the others and, with the client and in the courts, did the legal acts defined by that state as the practice of law.”  Cf. Florida Bar v. Savitt, 363 So. 2d 559 (Fla.1978) (presenting a list of prohibited and permitted activities by members of an interstate – international partnership.

The scope of my  activity as a foreign attorney partner of George Chernoff, a member of the federal count in New York is adjacent to the problem presented in Sperry v. Florida, 373 U.S. 379, 83 S.Ct. 1322, 10 L.Ed.2d 428 (1963). Federal statutes authorize the Commission of Patents [BIA, Bureau of Immigration Appeal] to prescribe regulations governing the recognition and conduct of agents, foreign attorneys and other persons representing applicants before these federal offices. Sperry, who was a patent agent, recognized by the Commissioner of Patents, maintained an office in Tampa, Florida where he held himself out to be public as practicing patent law. The Supreme Court of Florida enjoined Sperry from engaging in the practice of law, including specific prohibitions against rendering legal opinions as to patentability and infringement, and against holding himself out as qualified to prepare and prosecute applications for letters patent.   Applying the Supremacy Clause the Supreme Court vacated and remanded the decree “since it prohibits [Sperry] from performing tasks which are incident to the preparation and prosecution of patent applications before the Patent Office.”

In my case the issue defining the degrees of activity in Florida involving an international interstate partnership following the principles established in FLA BAR v Savitt, is if, which will constitute the unauthorized practice of law in Florida by me, a foreign attorney non-admitted in Florida who did maintains a principal office for the practice of law in my jurisdiction of admission in addition to others branches in Florida and in New York compare Spanos v. Skouras Theatres Corp., 364 F.2d 161 (2d Cir.), Cert/Petition denied, 385 U.S. 987, 87 S.Ct. 597, 17 L.Ed.2d 448 (1966) (in banc) (client liable for fees for out of court services rendered over five years period by attorney admitted in California in connection with antitrust case pending in federal court in New York where, if application had been made, California attorney would have been admitted pro hac vice.

The scope of my activity as partner of George Chernoff New Yorkattorney is analogous to the issue presented in Sperry v. Florida, 373 U.S. 379.

The FLASC has ruled, in my case, against its own previous decisions, not only regarding the unauthorized practice of law, status of limitation, discovery procedures and civil procedures, but to my international interstate partnership agreement with a New York attorney.

The scope of my activity as a member of a foreign bar submits that the FLASC injunction fails to recognize and excluded from its prohibitions my right to practice federal and non-Florida law. My contention has two aspects, the first prong of the argument rests on George Chernoff’s status as a member of the bar of the Appellate Division of the Supreme Court of the State of New York, First Judicial Department, and the USSC. That court, of course, controls whom it will recognize as members of its bar; it is not a matter within the direct control of FLASC or any state court. The decree in my case is not to be interpreted to prohibiting me from appearing before the U.S. Federal Agency for the State of Florida any more than it could be interpreted to prohibit my appearing before the foreign Tribunal of Appeals where I am also admitted. My right to practice before the local federal agencies is not limited to physical presence before the federal court’s judges, magistrates, and BIA Officials [Board of Immigration Appeals].

Current court’s decision seconding the conviction on my position:

FLASC did violate my Due process rights, that is, the legal requirement that the state must respect all of the legal rights that are owed to a person. Typically, “Due process” means 1) Notice, generally written, but some courts have determined, in rare circumstances, other types of notice suffice. Notice should provide sufficient detail to fully inform the individual of the decision or activity that will have an effect on his/her rights or property or person. 2) Right to grieve (that being the right to complain or to disagree with the governmental actor/entity that has decision making authority) and 3) the right to appeal if not satisfied with the outcome of the grievance procedure. Due process balances the power of law of the land and protects the individual person from it. When a government harms a person without following the exact course of the law, this constitutes a due-process violation, which offends against the rule of law.  The following is a recent ruling supporting my position stated herein, that the scope of my activity as a member of a foreign bar submits that the FLASC injunction fails to recognize and exclude from its prohibitions my right to practice federal and non-Florida law. Attorney Has Due Process Right To Notice Of Alleged Rule Violations

The Utah Supreme Court has reversed findings of misconduct, concluding that the accused attorney had been denied due process.  A screening panel found that the attorney violated Rules 1.2, 1.4 and 8.4(a).

The attorney had not been placed on notice of the alleged Rule 1.2, which violated his due process rights. The court found insufficient evidence of the remaining violations, concluding that the conduct at issue was addressed in Rule 1.1 (competence) rather than Rule 1.4 (communication). The screening panel declined to find a Rule 1.1 violation.

The court held that conduct covered by one rule cannot be sanctioned by reference to another rule. (Mike Frisch)

“The  Supreme Court in my case has ruled against its own previous decisions, not only regarding the unauthorized practice of law, status of limitation, discovery procedures and civil procedures, but to my international interstate partnership agreement with a New York attorney.”

The principle of stare decisis can be divided into two components. The first is the rule that a decision made by a superior court, or by the same court in an earlier decision, is binding precedent that the court itself and all its inferior courts are obligated to follow. The second is the principle that a court should not overturn its own precedent unless there is a strong reason to do so and should be guided by principles from lateral and inferior courts. The second principle, regarding persuasive precedent, is an advisory one that courts can and do ignore occasionally.

The Supreme Court of California’s explanation of this principle is that, [u]nder the doctrine of stare decisis, all tribunals exercising inferior jurisdiction are required to follow decisions of courts exercising superior jurisdiction. Otherwise, the doctrine of stare decisis makes no sense. The decisions of this court are binding upon and must be followed by all the state courts of California. Decisions of every division of the District Courts of Appeal are binding upon all the justice and municipal courts and upon all the superior courts of this state, and this is so whether or not the superior court is acting as a trial or appellate court. Courts exercising inferior jurisdiction must accept the law declared by courts of superior jurisdiction. It is not their function to attempt to overrule decisions of a higher court.

Scalia demonstrates how to recover from an apparent misstep with a ‘Scalia culpa,’ says reporter:

Justice Antonin Scalia relied on an often-used quotation last week when he admitted overlooking an issue in a prior case which led to the appearance of inconsistency.  Scalia was called to task by Justice Ruth Bader Ginsburg, who said he apparently changed position when he argued in a dissent last week that the U.S. Supreme Court should have dismissed a case as improvidently granted. Scalia had argued in the dissent that the real issue in the case was whether the federal appeals court abused its discretion in denying the defendant permission to appeal. As a result, he argued, the majority should not have decided a removal issue. Yet that problem did not deter him in an earlier case.

In a Sidebar column, New York Times SCOTUS correspondent Adam Liptak describes Scalia’s recovery from the apparent flip-flop as a “Scalia culpa” involving three steps.

First, Liptak says, Scalia openly admitted the apparent change in position from an earlier case. Second, Scalia supported his acknowledgement with a “classy quotation” from former Justice Robert H. Jackson. Third, he returned fire, noting Ginsburg had used the same quotation when she shifted positions.

Scalia said the prior opinion was resolved without reference to the abuse of discretion question. “As for my own culpability in overlooking the issue,” Scalia wrote, “I must accept that and will take it with me to the grave. But its irrelevance to my vote in the present case has been well expressed by Justice Jackson, in a passage quoted by the author of today’s opinion: ‘I see no reason why I should be consciously wrong today because I was unconsciously wrong yesterday.’ ”   University of Chicago law professor Justin Driver wrote in the Georgetown Law Journal in 2011 that the Jackson quote is one of three often used to explain a shift in a judge’s thinking, Liptak notes.

The others:

• From Justice Joseph Story in an 1827 opinion: “My own error … can furnish no ground for its being adopted by this court.”  • From Justice Felix Frankfurter in a 1949 dissent: “Wisdom too often never comes, and so one ought not to reject it merely because it comes late.”

The Connecticut Supreme Court upheld as mandatory the six-year disciplinary statute of limitations for most violations

The issue that we must decide in this case is whether the six year limitation period set forth in Practice Book § 2-32 (a) (2) (E) constitutes a mandatory bar to grievance complaints brought after that six year limitation period has expired or whether the provision, instead, is discretionary. On April 4, 2014, Wesley S. Spears filed a grievance complaint against the defendant, Attorney Joseph Elder, alleging that the defendant had engaged in professional misconduct in 2004. A reviewing committee of the Statewide Grievance Committee conducted a hearing on the grievance complaint and found by clear and convincing evidence that the defendant had violated certain of the Rules of Professional Conduct. The reviewing committee also directed the plaintiff, the Disciplinary Counsel, to bring this presentment action against the defendant. After the plaintiff brought this action in 2015, the defendant filed a motion to dismiss, claiming that the action was barred by § 2-32 (a) (2) (E). The trial court concluded that the time limitation set forth in § 2-32 (a) (2) (E) is not mandatory and denied the motion to dismiss. After a trial to the court, the trial court concluded that the defendant had violated certain of the Rules of Professional Conduct and ordered that the defendant be suspended from the practice of law for a period of one year. The defendant then filed this appeal. We conclude that § 2-32 (a) (2) (E) bars grievance complaints that are not brought within the six year limitation period unless one of the exceptions set forth in § 2-32 (a) (2) (E) (i) or (ii) applies. Because none of these exceptions applies in the present case, we reverse the judgment of the trial court and remand the case to that court with direction to grant the defendant’s motion to dismiss.

The story is a complicated one that led to this finding

The presentment action was tried to the court, which concluded that the defendant had violated rules 4.1 and 8.4 of the Rules of Professional Conduct by misrepresenting himself to a third person in the course of his representation of a client. As a sanction, the trial court ordered that the defendant be suspended from the practice of law for a period of one year.

The court

We conclude that the most reasonable interpretation of this rule is that the judges of the Superior Court intended that the six year period of limitation set forth in Practice Book § 2-32 (a) (2) (E) would bar any untimely complaints unless one of the exceptions set forth in subparagraph (i) or (ii) applies. We can think of no reason why our judges would expressly impose a specific period of limitation and then effectively eviscerate that limitation period by conferring unfettered discretion on the screening panel to ignore it…

Our determination that the time limitation set forth in Practice Book § 2-32 (a) (2) (E) is mandatory finds support in the underlying purpose of disciplinary proceedings, which is ‘‘to preserve public confidence in the system and to protect the public and the court from unfit practitioners.’’ Massameno v. Statewide Grievance Committee, 234 Conn. 539, 554, 663 A.2d 317 (1995). The purpose is not to punish the attorney. E.g., Statewide Grievance Committee v. Shluger, 230 Conn. 668, 675, 646 A.2d 781 (1994). When an attorney has not engaged in any professional misconduct for six years prior to the date that a grievance complaint has been filed, and none of the exceptions set forth in § 2- 32 (a) (2) (E) (i) or (ii) applies, it reasonably may be presumed that the attorney does not pose a continuing danger to the public or the court. Our interpretation is also bolstered by the policies underlying limitation periods generally, ‘‘namely, to prevent the unexpected enforcement of stale claims and the impairment of proof wrought by lost witnesses and/or evidence.’’ Flannery v. Singer Asset Finance Co., LLC, 312 Conn. 286, 309 n.23, 94 A.3d 553 (2014).

Thus

In the present case, the sole reason that the trial court gave for denying the defendant’s motion to dismiss was that the six year limitation period set forth in Practice Book § 2-32 (a) (2) (E) is not mandatory. Because we have concluded that the limitation period is mandatory unless one of the exceptions set forth in § 2-32 (a) (2) (E) (i) or (ii) applies, we conclude that the trial court improperly denied the defendant’s motion to dismiss.

The violations not subject to limitations

‘‘Notwithstanding the period of limitation set forth in this subparagraph, an allegation of misconduct that would constitute a violation of Rule 1.15, 8.1 or 8.4 (2) through (6) of the Rules of Professional Conduct may still be considered as long as a written complaint is filed within one year of the discovery of such alleged misconduct.’’ Practice Book § 2-32 (a) (2) (E) (ii) provides: ‘‘Each period of limitation in this subparagraph is tolled during any period in which: (1) the alleged misconduct remains undiscovered due to active concealment; (2) the alleged misconduct would constitute a violation of Rule 1.8 (c) and the conditions precedent of the instrument have not been satisfied;(3)the alleged misconduct is part of a continuing course of misconduct; or (4) the aggrieved party is under the age of majority, insane, or otherwise unable to file a complaint due to mental or physical incapacitation.’’

ATENCION: Precisa que lean todos los detalles y sigan las instrucciones según se explican para que logren esta ayuda financiera federal. Este programa del Departamento de Educación, aunque lo llamamos becas, el gobierno lo llama “ayuda financiara para obtener empleo.” Y es totalmente gratis.

Esta solicitud de ayuda financiera federal del Departamento de Educación programa de Rehabilitación Vocacional [VR-DOE siglas en inglés]  inicialmente Usted el/a solicitante debe hacer las gestiones directamente con la oficina que le corresponde a su lugar de residencia. ¿Cómo calificas para la ayuda de beca para rehabilitación vocacional del Departamento de Educación?

Para saber si puedes calificar Y obtener esta ayuda economica 100% que cubre todos los costos pagaderos por el programa de rehabilitación vocacional financiada con fondos federales del Departamento de Educación, Usted debe:

Tener alguna condición física o mental o estrés mental o anciedad emocional que le causa a Usted un “impedimento sustancial” a su capacidad para obtener trabajo especialmente en su profesión.

Por ejempo, especialmente- porque no puede trabajar en la carrera y profesión estudiada y graduada/o por usted- lo mismo dentro o fuera de Estados Unidos- este problema de no poder poder trabajo y ejercer su carrera le crea una condición de estrés mental o anciendad emocional es causa de no poder hacer los estudios y la homologación prerequisitos requeridos para poder obtener la licencia y certificación oficial para trabajar- y así poder beneficiarse de los servicios de RV que pueda capacitarse para conseguir un trabajo en su área de conocimiento.

Si Usted recibe Seguridad de Ingreso Suplementario (SSI) o Seguro de Discapacidad del Seguro Social (SSDI), Usted automáticamente será elegible para  este programa VR a menos que su discapacidad sea tan grave que no se beneficiará al ser parte de un programa de VR.

Si Usted tiene alguna discapacidad medica, discapacidad fisica o emocional puede pedir beca y beneficiarse de los servicios de RV para lograr re-capacitarse y poder buscar y obtener un trabajo adecuado a sus conocimientos.

El Departamento de Educación y rehabilitación vocacional de algunos estados depende de la agencia de servicios humanos y de salud, mientras que el de otros depende solamente del Departamento de Educación. En los EE. Además, la mayoría de las personas que cobran beneficios por discapacidad tienen derecho a servicios gratuitos de rehabilitación vocacional, como capacitación y colocación laboral.

Los programas de rehabilitación vocacional (VR) son programas administrados por el Departamento de Educación del estado y financiados por el gobierno federal que ofrecen una forma para que las personas con algún tipo de discapacidades mentales y físicas obtengan la ayuda que necesitan para volverse más independiente y volver al trabajo deseado y capacitado.

Estos son algunos de los servicios que este programa de rehabilitación vocacional [“VR”] puede ofrecerle:

Primero recibes una evaluación y posible entrevista personal de su  discapacidad para ver si es elegible y para determinar cómo la RV puede ayudarlo- si usted tiene alguna discapacidad fisica- auditiva- visual- multiple- hacerlo saber a la persona entrevistadora del pograma ‘VR’ y recibes el derecho a obtener el 100% de toda esta asistencia y ayuda:

Formación profesional (trabajo) y de otro tipo;

Formación, educación y capacitación para el trabajo;

Servicios de asesoramiento, orientación y referencia laboral

Rehabilitación física y mental;

Asistencia financiera mientras recibe algunos servicios de rehabilitación de COV;

Transporte necesario para llegar a algunos servicios de rehabilitación de COV;

Un intérprete (si en caso es sorda/o);

Servicios de lectura (si en caso es ciega/o);

Ayuda en la transición de la escuela al trabajo (para estudiantes);

Servicios de asistencia personal;

Servicios y dispositivos de tecnología de rehabilitación;

Servicios de empleo con apoyo, y ayuda a encontrar un trabajo de acuerdo a su educación;

La ley requiere que las agencias estatales ofrezcan al menos los servicios descritos anteriormente, aunque su estado puede ofrecer algunos servicios adicionales como por ejemplo dinero para comprar vestimenta apropiada cuando va a entrevista de empleo y buscar trabajo.

¿Qué pasa si quiero volver a la escuela para estudiar otra carrera o avanzada en mi carrera?

Si desea volver a la escuela, puede ser elegible para una beca de la Escuela NAFA LAW a la que asiste o planifica asistir. Si acepta una beca de VR, puede trabajar para una agencia pública del estado de rehabilitación dos años por cada año de dinero de la beca a tiempo completo que reciba.

¿Cómo afecta el programa del VR a mi elegibilidad para los beneficios jubilación o del Seguro Social o SSI por discapacidad?

Si está inscrito en un programa de VR, el SSA no revisará su elegibilidad en función de los requisitos médicos por discapacidad, pero cualquier ingreso que obtenga puede afectar su elegibilidad SSI o el monto de sus beneficios y al jubilarse. Sin embargo, el SSA tiene programas de incentivos laborales que pueden ayudar a minimizar cualquier impacto potencial que tenga su regreso al trabajo en sus beneficios, a través de lo que se llama el programa Boleto para trabajar.

REGLA 16 a 1.2 DEFINICIONES

Un consultor legal extranjero es cualquier persona que:

(a) ha sido autorizado para ejercer en un país extranjero como un abogado, consejero de la ley, o el equivalente para un período de por lo menos 5 de los 7 años inmediatamente anteriores a la solicitud de certificación bajo este capítulo;

(b) se ha involucrado en la práctica de la ley del país extranjero por un período de por lo menos 5 de los 7 años inmediatamente anteriores a la solicitud de certificación bajo este capítulo y se ha mantenido en buen estado como un abogado, consejero de la ley, o el equivalente a lo largo de dicho período;

(c) está autorizado para ejercer en un país extranjero cuyas disciplinario profesional del sistema para los abogados es generalmente concuerda con el del Colegio de Abogados de la Florida;

(d) no ha sido sancionado por mala conducta profesional por parte de la barra o de los tribunales de cualquier jurisdicción dentro de los 10 años inmediatamente anteriores a la solicitud de certificación bajo este capítulo y no es objeto de cualquier procedimiento disciplinario o investigación pendiente en la fecha de solicitud de certificación bajo este capítulo;

(e) no se le ha negado la habilitación para ejercer ante los tribunales de cualquier jurisdicción basada en el carácter o la condición física durante el período de 15 años anteriores a la solicitud de certificación bajo este capítulo;

(f) ha presentado, de conformidad con los requisitos determinados por la Corte Suprema de la Florida, una solicitud de certificación bajo este capítulo y los derechos correspondientes;

(g) se compromete a respetar las reglas aplicables Regulación de Abogados de Florida y someterse a la jurisdicción de la Corte Suprema de Florida por razones disciplinarias;

(h) es mayor de 26 años de edad;

REGLA 16 a 1.3 ACTIVIDADES

(A) Representación Legal. Una persona certificada como un consultor legal extranjero en el presente capítulo podrá prestar servicios legales en el estado de Florida, a condición, sin embargo, que dichos servicios:

(1) se limita a las relativas a las leyes del país extranjero en el cual se admite dicha persona para ejercer como abogado, consejero de la ley, o su equivalente;

(2) no incluye ninguna actividad o cualquier otro servicio que constituye la práctica de las leyes de los Estados Unidos, el estado de Florida, o en cualquier otro estado, libre asociado o territorio de los Estados Unidos o el Distrito de Columbia, incluyendo pero no limitado a, las restricciones que dicha persona no podrá:

¿Qué es el GOODWILL de una empresa?

“Buena voluntad” [traducción literal de Goodwill]  o Buena Reputación- frente a otros activos intangibles: ¿cuál es la diferencia?

¿Qué es el GOODWILL de una empresa? En la economía de la empresa y en contabilidad, el fondo de comercio (en inglés, “goodwill”es el valor actual de los superbeneficios que produce una empresa y su comercialización.

Corresponde al valor inmaterial que está derivado de factores como la clientela, la eficiencia, la organización, el crédito, el producto, el prestigio, la experiencia, patentes, marcas, programas, etc.

Fondo de comercio versus otros activos intangibles: una visión general.

Uno de los conceptos que pueden ayudar a las personas de negocios no contables (e incluso contables) es la distinción entre la plusvalía y otros activos intangibles en los estados financieros de una empresa. Quizás sea de esperar la confusión. Después de todo, la buena voluntad (“Goodwill”) denota el valor de ciertos recursos no monetarios, no físicos del negocio, y eso suena exactamente como lo que es un activo intangible.

Sin embargo, hay muchos factores que separan la plusvalía de otros activos intangibles, y los dos términos representan partidas individuales en un balance general.

Si bien la “buena voluntad” y los “activos intangibles” a veces se usan indistintamente, existen diferencias significativas entre los dos en el mundo contable.

Buena voluntad “goodwill”:

El fondo de comercio es una categoría miscelánea para activos intangibles que son más difíciles de analizar individualmente o medidos directamente. La lealtad del cliente, la reputación de la marca y otros activos no cuantificables cuentan como el valor principal de la buena voluntad.

El historial de innovación e investigación y desarrollo de una empresa y la experiencia de su equipo directivo a menudo también se incluyen. La buena voluntad no puede existir independientemente del negocio, ni puede venderse, comprarse o transferirse por separado del negocio. Como resultado, la buena voluntad tiene una vida útil, un valor único que es indefinido, a diferencia de la mayoría de los otros activos intangibles.

La buena voluntad solo aparece en un balance general cuando dos compañías completan una fusión o adquisición. Cuando una empresa compra otra empresa, todo lo que paga más allá del valor neto de los activos identificables del objetivo se convierte en buena voluntad en el balance general.

Digamos que una compañía de refrescos fue vendida por $120 millones; tenía activos por valor de $100 millones y pasivos de $20 millones. Otros activos intangibles:

Los activos intangibles son aquellos que no son físicos, pero son identificables. Piense en la tecnología patentada de una empresa (software de computadora, etc.), programas, derechos de autor, patentes, acuerdos de licencia y nombres de dominio de sitios Web. Estas no son cosas que uno pueda tocar exactamente, pero es posible estimar su valor para la empresa. Los activos intangibles NO se pueden comprar y vender independientemente del negocio en sí.

También hay una distinción clave en cómo se modifican las dos clases de activos una vez que están en los libros. Consideraciones Especiales:

El Consejo de Normas de Contabilidad Financiera (FASB) recientemente presentó una nueva regla alternativa para la contabilidad de la plusvalía. Durante mucho tiempo, podría amortizarse en un período de 40 años. Un fallo de 2001 decretó que la plusvalía no podía amortizarse, sino que debía evaluarse anualmente para determinar la pérdida por deterioro; Este proceso de valoración anual era costoso y lento.

Ahora, según la norma alternativa FASB para empresas privadas (2012) (ampliado en 2017 para empresas públicas), la plusvalía se puede amortizar de forma lineal durante un período que no exceda los 10 años. La necesidad de evaluar el deterioro ha disminuido; en cambio, se registra un cargo por deterioro cuando ocurre algún evento que indica que el valor razonable puede haber ido por debajo del valor en libros. Estas reglas se aplican a las empresas que se ajustan a los principios de contabilidad generalmente aceptados (GAAP) utilizando un método de contabilidad de acumulación total. Si las condiciones indican que el valor en libros puede no ser recuperable, se realizan pruebas de deterioro.

Las pequeñas empresas que utilizan la contabilidad en efectivo o la contabilidad en efectivo modificada pueden usar las tarifas legales establecidas por el Servicio de Impuestos Internos (IRS). El IRS permite un período de cancelación de 15 años para los intangibles que se han comprado. Hay mucha superposición, así como el contraste entre los informes del IRS y GAAP.

Diferencias clave:

Si bien la “buena voluntad” y los “activos intangibles” a veces se usan indistintamente, existen diferencias significativas entre los dos en el mundo contable. El fondo de comercio es una prima que se paga sobre el valor razonable de los activos durante la compra de una empresa. Por lo tanto, está etiquetado a una empresa o negocio y no se puede vender o comprar de forma independiente, mientras que otros activos intangibles como licencias, patentes, etc. se pueden vender y comprar de forma independiente. Se percibe que el fondo de comercio tiene una vida indefinida (siempre que la empresa opere), mientras que otros activos intangibles tienen una vida útil definida. Una empresa que no tiene “goodwill” su valor es solo el valor de lo tangible- puede ser el valor de bienes reales, equipos, muebles y otros materiales tangibles.
