Program Description
The National Association for Foreign Attorneys (NAFA Law Association) has continually advocated for the reciprocity rule since 1992 when The Florida Supreme Court agreed to review the proposal for admission to the practice of law through reciprocity for foreign attorneys known as Chapter 16 - Foreign Legal Consultant. Reciprocity is the mutual exchange of privileges between states, nations, companies or individuals for commercial or diplomatic purposes.
A registered foreign legal consultant (FLC) is an attorney or legal advisor (or equivalent) licensed in another country who has received special certification from the State Supreme Court and the State Bar to represent to a client in their respective state. A foreign legal consultant may practice law on a limited basis in the United States. This includes Pro Hac Vice admission, administrative admission rules, and admission as in-house counsel advising a business or corporation in a particular field of state business law, or coordinating with outside counsel on litigation matters. E.g. See Florida Bar Admission Rules Chapter 16 - Chapter 17, Florida Supreme Court.
Following the Federal Code Title 8 CFR §292.1(a) 1 - 3, which means that, “Any lawyer – any person who is eligible to practice law in, and is a member in good standing of, any court, the supreme court of any state, any territory” or the Commonwealth of the United States, or the District of Columbia, and is not under any order to suspend, sanction, restrict, or otherwise prohibit him from the practice of law.”
In other words, what Title 8 CFR §292.1(a) 1 - 3 also means. Foreign attorneys can practice immigration law as an attorney under the condition that: if herementioned attorney is NOT certified in the US, by any supreme court, then they can only represent citizens of their country (the country of origin of the lawyer) and, at the time the client hires their services, said client is in the lawyer's country. The client, at the time of hiring, CANNOT be within the United States when beginning contract of legal services of mentioned lawyer.
Furthermore, following this rule applies very well to attorneys certified in any state of the United States as an FLC foreign law consultant, once they have been admitted by a state supreme court and by any state bar association, are then forthwith a member of the international law section of the FLC.
A (third) analysis, following the Savitt precedent, applies to lawyers certified in some US state, as a foreign law consultant, FLC, when they are associated with local lawyers who enter into a reciprocal agreement following the principles of Savitt.
Admission Requirements
(1) NAFA Membership Approval*;
(2) Foreign law degree transcripts;
(3) Maintain good fitness and character, according to application and guideline
by the National Conference of Bar Examiners (NCBE) and the Court
Supreme of the State;
(4) Application to the State Bar Association;
(5) English language proficiency - TOEFL minimum score required:
a. online requires a minimum score of 90 points;
b. on paper - 590 points;
c. Internet-based - 250 points; or
d. through IELTS - 70 points;
(6) Two letters of recommendation;
(7) Submission of resume / curriculum vitae (CV);
(8) Written statement of purpose / intent in taking this course and program; and
(9) Telephone or video interview, if requested.
