We offer several programs for foreign professionals inside and outside the United States. This section is intended to serve as a guide to prepare foreign lawyers, graduates and notaries with the information and evidence necessary to prepare for the homologation process and the necessary steps for the revalidation of titles. External resources are provided for more information and studies that NAFA has conducted in gathering information for attorney reciprocity and exception rules for legal or professional practice in the United States. This guide is also intended to explain why it is much more beneficial for foreign lawyers to undergo certification and degree validation versus the common misconception of returning to a US law school.

As the population and economy continue to expand the horizons of the United States, the need for foreign attorney services will also increase. U.S. domestic investors with foreign business ventures, as well as international investors from abroad seeking opportunities in the United States, often need and would therefore benefit from the convenience of having foreign legal consultants, foreign attorneys, available to advise such questions relating to the foreign professional. Rather than overlapping or even conflicting, the activity of foreign lawyers/legal consultants complements the work of local lawyers called upon to anticipate the effects of an international transaction negotiated in the US or involving a US party. USA Local counsel examining a matter from the client's perspective may not always be prepared to adequately plan for all legal consequences arising from a transaction to be conducted, whether in whole or in part, in a foreign jurisdiction.
The need for foreign lawyers is also felt in the field of litigation. Litigation may arise as a natural consequence of the increase in international business in which the US plays an increasingly important role in the hemisphere and beyond. Along with the flow of foreign capital to the US, there is a parallel influx of foreign nationals. Many of these people own or come to own property in the US, including real estate, bank accounts, securities accounts and other assets.

Additional requirements for foreign lawyers
1. You do not have to be a citizen to be a licensed attorney in California, but you do have to
complete some additional documents.
2. If an applicant wishes to practice law in California as a foreign-educated applicant, no
admitted to practice law in any jurisdiction of the United States, they only have to follow
the instructions in the admission rule California Bar Rule - 'Title 4'.
3. Attorneys who are already admitted to the active practice of law in a foreign country AND who are in
rule and in good conduct. These attorneys are qualified to take the Bar Exam
of California without having to complete any additional legal education. As it was before it was required
do an LLM master's degree in US Law.

According to the National Conference of Bar Examiners (NCBE) and its most recent 2022 Bar Admissions Guide, reciprocity is recognized in 33 of the 50 states in the United States. This reciprocity policy generates the standards, rules and guidelines that all state colleges must follow and also notes which states or jurisdictions that allow U.S. residents with a form of foreign legal education to practice, including eligibility to take the state bar exam. Despite other general fallacies mentioned in our FAQ section, there are several career options available to foreign lawyers in the US who are not US citizens and who have not received a bar or license to work as attorneys in their state of residence.
Since its infancy, NAFA has crafted, developed and supported various programs adopted by different agencies and academic institutions, including public universities the attempt to work expertly in legal fields seeking a state license or without a state license, including local, state and federal laws until they decide to take the bar exam.
Some of these optional purposes developed by NAFA include alternative careers such as immigration specialists, legal consultants foreigners (FLC) or international lawyers for human rights, for employers, including companies or corporations; Please note that there are also similar proposals available for other academic fields for licenciados and notarios while you are studying for the practice of general advocacy in the US and in process with NAFA. There are numerous resources available for foreign lawyers to pursue these different career paths and fulfill these purposes.
Most states require that lawyers have a law degree and pass a written state bar exam. Foreign attorneys with years of practice in their country of citizenship are eligible to take the bar exam once they take and receive a foreign equivalency certification in select states.
NAFA students undergo an effective and rigorous process of bar exam practice and training while UNPAM prepares the foreign equivalency certification for the NAFA student. The certification process is also important because, once completed, the Florida or State Supreme Court and the NCBE recognize that the person requesting certification can practice law.
The certification step is a step that recognizes foreign equivalency certification that will help the foreign attorney recognize or validate her qualifications for all other US states and territories. With this step and condition in effect, a copy of the applicant's or foreign attorney's recognized foreign equivalence certification is also sent to: (1) the National Conference of Bar Examiners (NCBE) and its respective (2) Bar Association, in order to complete the homologation process.
Once this part of the process is completed, you will meet the recommended state bar, or California bar, requirement for a certification that can only be approved by the National Conference of Bar Examiners (NCBE) or the American Bar Association ( ABA).

The duration of this process can reach between 12 and 16 months on average (the time may vary depending on the state of the United States where the applicant wants to practice), during which NAFA prepares the foreign lawyer for the studies that give you access to NAFA academic programs and educational seminars, including taking the exam

As clearly stated by the California Bar (The State Bar of California ), it is not a requirement that a foreign attorney or those who hold a law degree be U.S. citizens if they intend to take the California Bar Exam.
If an applicant wishes to practice law in California as a foreign educated applicant not admitted to practice law in any jurisdiction of the United States, some of these qualification guidelines do not apply to attorneys(1) who are already admitted to practice and are in the active practice of law in a foreign countryor in another US jurisdiction and (2) are in good standing. These foreign attorneys are qualified to take the California bar exam without having to complete any additional legal education. Part of the fulfillment of this requirement for foreign attorneys by the California State Bar, as well as among other states and US employers, is the requirement for a certification of foreign equivalence or evaluation of foreign credentials by a recognized credential evaluation agency - Guidelines for Applicants with a Foreign Law Degree. UNPAM would service in this step, as the applicant's foreign credential evaluation agency, to meet this requirement for foreign lawyers. Additionally, guidance is provided to the NAFA applicant or student throughout the application process as another part of the services offered.
Graduates and Notaries:However, according to the California Bar, it is in fact a requirement that people who have studied law without experience in a foreign state or country can qualify as general applicants with the condition that they demonstrate and provide the following before being eligible to take the bar exam, in this case with graduates without work experience:
• To have a first law degree, acceptable to the Committee, from a law school in a state or foreign country and to have completed one year of law education at a law school approved by the American Bar Association (ABA) or an California-accredited law school in areas of law prescribed by the Committee; or
• Have a legal education from a law school located in a foreign state or country without a first law degree, acceptable to the Committee, and
- Have met general education requirements;
- Have studied law as permitted by these rules in a law school, in a law office, or in a judge's courtroom, or by any combination of these methods; and
- Have passed or passed the First-Year Law Students' Examination in accordance with these rules and policies of the Committee.

Applicants must submit letters from four (4) or more persons whom are licensed to practice in any foreign jurisdiction in the country in which the applicant is licensed to practice (their country). If the applicant is not authorized to practice, then letters of recommendation from the educational institution in which the applicant received their legal education must be submitted as a requirement. Letters should be addressed to the Committee on Bar Admission. In this case, said educational institution must recommend and express the knowledge and most recent achievements of the applicant. The second and previous most recommended purpose made to members and associates was NAFA's academic program in preparation for the Louisiana Bar Exam under Rule XVII - Section Six [6].
The Louisiana State Bar Association does not require a foreign attorney to have years of practice within his or her state, but does require the foreign attorney to attend and complete 14 credit hours at an ABA-approved law school. This requirement, also noted in the NCBE Chart, is a similar requirement for foreign law students (non-graduates) who intend to take the California bar exam.
Over the years of adopting a successful and well-proven academic program to prepare its students, NAFA has received many testimonials and success stories in preparing its students and members to pass the bar exam, including the Louisiana State Bar.
Educated Foreign Attorneys:Foreign-trained attorneys who wish to apply to take the Louisiana Bar examination must do so in accordance with Rule XVII of the Louisiana Supreme Court, Sec 6.
Requirements:Equivalency Application Package: If you attended a law school outside of the United States, you must have an equivalency application.
The biggest difference between these other agencies and institutions compared to NAFA, is the education, studies and training that the institution offers to students and members with the tools to prepare for your future in continuing education and academic programs post-secondary. NAFA's expertise in continuing legal education (CLE) expands into several fields of law, including US federal and state law, immigration law, rights laws human rights and commercial arbitration law.
UNPAM is authorized by the US Department of Education of Puerto Rico, while in compliance with the policies, rules and laws that govern these educational agencies and institutions, to grant homologations or evaluations of foreign credentials for equivalence. These credential evaluation agencies, academic institutions or universities, in addition to UNPAM, determine the equivalence or current level of education received by the foreign law graduate or foreign lawyer. This additional requirement that includes a detailed course-by-course evaluation of the foreign lawyer's foreign academic credentials report or evaluation is met with the assistance of NAFA, once the foreign lawyer begins the homologation process with UNPAM.
The additional requirement or service fulfilled by UNPAM is a certified and notarized translation into English of any and all academic evidence, including academic transcripts, curriculum vitaes (CVs) and letters including letters of recommendation, to obtain with Successful registrations for a foreign academic equivalence for a successful and quick presentation.
During this time period of the equivalence process is when NAFA provides the student with graduate level coursework to restructure their current level of equivalence at or above the recognized master's level to complement their current fields of specialization. There are numerous different academic concentrations that NAFA offers in law that focus on general law, immigration, human rights, arbitration law, business law, education, among others.
NAFA is responsible for the entire administrative procedure and process, in addition to the study plan, academic training and preparation for the bar exam, in short, until the student or member believes that he or she is prepared to take the admission exam to the bar. bar of lawyers.

As documented in Chart 4: Foreign Legal Education of the NCBE Bar Admission Guide 2021 (NCBE Bar Admissions Guide 2021; link to 2021 Complete Guide), upon passing the California or Louisiana Bar examination, the Foreign attorneys have reciprocity to practice in 33 other states.

As part of its purpose and mission, NAFA satisfies the following minimum requirements for each and every one of its qualified foreign attorneys:
1. Application procedures to be admitted by the state Supreme Court.
2. Application procedures to be admitted by the state Bar Association.
3. Application procedures for admission to the National Conference of Bar Examiners (NCBE).
4. The certification of foreign equivalence and evaluation of foreign credentials provided by UNPAM.
5. To present these tests, the certification of foreign equivalence and evaluation of foreign credentials must already exist, if the applicant still:
(a) they want higher education;
(b) are looking for professional work; or
(c) are filing to obtain a professional visa in the USA
6. The proven education provided by NAFA post-secondary academic programs to complement the applicant's current education to ensure that the applicant:
(a) is certified by UNPAM as having received higher education from a foreign country (as a graduate or postgraduate depending on years of experience) and
(b) which is prepared and trained by NAFA with the subjects and topics required of the American lawyer, specialized for the foreign lawyer.
This test is a complementary test sent to also further satisfy the requirements of1. - 5.as read previously.
In addition to all this, NAFA will help educate the applicant as a student based on her choice or field of expertise with various well-tested academic programs. And when NAFA files these aforementioned applications, they do so with the full representation of the applicant throughout the entire process, including court services, investigations, and translations. Furthermore, UNPAM has been approved and admitted by various state supreme courts and other regulatory authorities with a 100% approval rate with no rejected cases.
Since January 2019 we only have 6 States which have the opportunity which allows you to apply for admission and take the bar exam once has completed an LLM course [26 credits - Master's in US law] two (2) semesters. And we have an Additional state (Louisiana) which only requires 14 credits of study in US law, one semester. After passing the bar exam in one of these states of reciprocity. you may begin the process to freely exercise the State and Federal law.
We encourage for you to conduct your personal research; foreign lawyers intending to engage in general law practice will find that most states and jurisdictions (there are only 7) do not require a law degree such as an LL.M. from an ABA-accredited law school, with the exception of the state of California.
NAFA helps guide and advise its members and associates with the right amount of education and academic services acquired in addition to the education received by NAFA. The amount of time and financial tuition that is greatly saved to receive such education for a foreign lawyer is only part of the service and benefit offered by NAFA, unless they decide to pursue that alternative.
Other states may make more restrictions and requirements, such as years of practice in the US. Finally, you may also need to pass a qualifying exam, such as the TOEFL exam.
During and after the application process with NCBE, the only course requirement foreign attorneys must take is a bar exam review course. NAFA offers courses in preparation or review for the bar exam online or in person, and video lectures on NAFA property or provided by NAFA academic staff, in addition to accessing courses through BarMax, access to videoconferences through The Great Courses for enrichment in topics of American law and its government. To have better preparation, although it is not a requirement of the California Bar, it is highly recommended that students enroll in NAFA's academic program called 'Law School for All', built to educate, train and prepare foreign lawyers for the state bar exam. This academic program is equivalent to an LLM master's degree. in US law (Master's degree in US law for foreign lawyers).

The Florida Bar's Foreign Legal Consultant Rule allows a foreign attorney to obtain certification in Florida as a Foreign Legal Consultant authorized to give legal advice to clients regarding the laws of the jurisdiction under which the attorney is admitted to practice law. The Regulatory Rules of the Florida Bar (Florida Bar): Chapter 16 explains the requirements to obtain certification. Foreign legal consultants may also work as intermediaries for U.S. law firms and corporations between courts in their country of practice. Foreign legal consultants may be needed in their areas of expertise on behalf of that law firm, and may also work under federal law in fields such as commercial arbitration, probate, family law, business formation, litigation or immigration, among others. . While it is true that these foreign attorneys may be restricted from advising or serving as attorneys, they may nevertheless continue to serve as attorneys in their country of license or may serve as attorneys under foreign law, in the same manner as American attorneys act as attorneys in their state. Despite that, the years of experience also included are the most desired and rated by American law firms, corporations, organizations, and employers alike.
Finally, international lawyers or foreign legal consultants (FLC) are also good candidates as experts in areas of federal law, particularly immigration law. Foreign legal consultants may represent immigrants as clients in the United States. In accordance with Title 8 of the US federal regulations governing "Aliens and Nationality", specifically 8 CFR § 292.1, subsection (6) Attorneys outside the United States:
NAFA currently offers weekly courses and classes for students interested in the Immigration Specialist program. Topics on current federal and immigration laws are reviewed and studied. Topics on policies and procedures placed by government agencies such as USCIS and DHS are found throughout the course.

Additionally, in affiliation with the AICAC court, beginning in 2022 - 2023, NAFA offers an academic program equivalent to a master's degree LL.M. in human rights and arbitration. Currently, NAFA, with part of its academic staff of practicing lawyers and professors with experience in human rights, has developed an academic program suitable for students interested in working in the immigration specialization.
NAFA President, Dr. Humphrey Humberto Pachecker, previously served as Vice Chairman of the International Law Section (ILS) of the American Bar Association (ABA). Dr. Pachecker has also provided support and is an advocate for foreign legal consultants and international lawyers and with the national program for Foreign Legal Consultants since its inception. Dr. Pachecker has also written books and articles on human rights issues, such as unequal education and the struggles faced by educators around the world, and the global crisis facing Latin America.

The ABA has created model rules recommended to all state bars for the licensure and practice of foreign legal consultants. In accordance with this Model Rule, there is a summary table by state comparisonof the permitted state functions of foreign legal consultants, the requirements, and whether there is reciprocity in that state.

Notice: Among the 33 US states (including one US territory), we have two (2) states that, unlike the others 31 states require that a foreign lawyer be able to practice as a foreign legal consultant (FLC) and must have a bar exam and pass it. For example, one of these two states is Utah:
The Multistate Professional Responsibility Examination (MPRE), developed by NCBE, is a two-hour, 60-question multiple-choice exam administered three times a year.. It is NOT a requirement for admission to the bar as a foreign legal consulting attorney from the 31 states, except two jurisdictions in the United States. A notary public is a public official appointed and commissioned by the Governor whose duty is to administer oaths (or affirmations); take acknowledgments; attest to the truthfulness of photocopies of certain documents; and perform other duties specified by Florida law. In the state of Florida, notaries may take affidavits, draft safe deposit box inventories, draft protests for payment of unpaid checks and promissory notes, perform marriages, or serve as official witnesses. Any law school nationally accredited by the American Bar Association (ABA), foreign lawyers who graduate from these schools and with only a few additional studies can generally sit for the bar exam in 7 states. There are 203 ABA-accredited schools, divided between 200 with full accreditation and 3 with provisional accreditation.
